1. Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and Base Unit LLC, a Wyoming limited liability company doing business as "SnapSwipe" ("we," "us," or "our"). By downloading, installing, or using the SnapSwipe mobile application (the "Service"), you agree to be bound by these Terms and our Privacy Policy. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICE AND MUST IMMEDIATELY UNINSTALL THE APPLICATION.

2. Eligibility & License

You must be at least 13 years of age to use the Service. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes on devices you own or control.

3. User Responsibility & Disclaimers

Data Responsibility: SnapSwipe is a tool to help you organize and delete photos. Any deletion of photos is final once cleared from your device's "Recently Deleted" or "Trash" folder. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR MEDIA. BASE UNIT LLC IS NOT LIABLE FOR ANY ACCIDENTAL LOSS OF DATA OR PHOTOS.

"As Is" Service: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4. Subscriptions & One-Time Purchases

Certain features require a "Pro" purchase or subscription.

  • •Payments are handled via Apple/Google and are subject to their respective terms.
  • •Subscriptions renew automatically unless cancelled 24 hours before the end of the period.
  • •Refunds are managed solely by the platform provider (Apple/Google).

5. Intellectual Property

All contents of the Service, including the SnapSwipe name, logo, designs, code, and interface, are the exclusive property of Base Unit LLC and are protected by international copyright, trademark, and other intellectual property laws.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASE UNIT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE LAST 12 MONTHS.

7. Indemnification

You agree to indemnify and hold Base Unit LLC harmless from any claims, losses, or legal fees arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

8. Dispute Resolution & Arbitration

Mandatory Arbitration: Most disputes can be resolved without litigation. You and Base Unit LLC agree to resolve any disputes through binding, individual arbitration rather than in court.

Class Action Waiver: YOU AGREE TO BRING CLAIMS AGAINST US ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the courts of Wyoming.

10. Modifications

We reserve the right to modify these Terms at any time. Significant changes will be announced via the app or site. Continued use of the Service constitutes acceptance of the new Terms.
